Book excerpt: The recently married Valeria Brinton uncovers an unsettling truth about her new husband, including a false identity and the potential murder of his first wife. Valeria is determined to solve the mystery of her husband's previous marriage and presumed guilt. Shortly after her wedding, Valeria Brinton learns her husband, Eustace Woodville, has been living a lie. His real name is Eustace Macallan and he was previously accused of murdering his first wife. Although he wasn't convicted, the Scottish verdict "not proven" left plenty of room for speculation. Yet, Valeria is committed to her husband and believes he's innocent. Despite the naysayers, she embarks on a journey to find the truth, clearing Eustace's name once and for all. The Law and the Lady is one of Wilkie Collins classic detective novels. It's a timeless tale of perseverance despite the looming judgement of nineteenth century society. The protagonist's unwavering faith and inquisitive nature makes for a compelling read that captivates one's spirit and imagination. With an eye-catching new cover, and professionally typeset manuscript, this edition of The Law and the Lady is both modern and readable.

Book excerpt: 'The Law and the Lady' is one of the most ingenious and most repulsive of Wilkie Collins's novels, and we doubt, if having begun, that anyone would leave it unfinished. The heroine marries a man and soon discovers that she is his second wife, and that he has been tried in Scotland for the murder of his first, — the jury returning a verdict of" Not proven," which, not establishing his innocence, simply declared that the evidence was not sufficient to convict him. She resolves to devote her life to the task of proving her husband's guiltlessness, and sets to work, without his knowledge. When he becomes aware that she has learned his secret, he leaves the country, convinced that she must despise him. The narrative of the wife's labors is intensely interesting, and marked by the ingenuity in handling and adapting evidence in which Mr. Collins is pre-eminent. In time the two are reunited, and later the wife's task is accomplished. Two characters, so original as horrible, figure in the story, — Miserrinius Dexter and his niece, Ariel. Though Dexter could not possibly belong to real life, he is the most striking and absorbing personage in the book. Whether the author violates physiological probabilities by endowing this mere atomy with the furious passions which controlled him, we shall not undertake to decide ; but it is certain that the rules of Scottish courts must differ widely from ours if they permit a witness under examination to argue and declaim as did Mr. Dexter at the trial of Macallan. Like all the author's novels, this one is wholly devoid of warmth and tenderness and the light of human affections : even in the love of Macallan and Valeria there is a somber reserve. But his admirers will find in the story no reason to abate their admiration for his power of construction and development.

A less sensational detective story is The Law and the Lady, in which new bride Valeria soon suspects her husband of having a secret past and a false identity. The novel attacks the Scottish Not Proven verdict, and is an early example of a female sleuth, a determined and resourceful woman who retains the initiative throughout.

The jury had not evidence enough to convict him -- nor enough to comfortably exonerate him. Eustace could not bear the weight of her discovery; he fled to the continent, to live in anonymity. But Valeria knew her husband, and she loved him. She knew he was innocent, too, with the sort of intuition that guides the lucky flawlessly. And she set out to prove it to the world.

ISBN 1-58477-354-5. Cloth $70. * Reprint of first edition. Parry [1863-1953] was an English municipal judge for over twenty years. His book, a guide for "the man in the street," which began as a series of newspaper articles, outlines the laws concerning insolvency, debt and poverty. It is distinguished by its emphasis on cultural attitudes toward the poor, and its readability and humanity. Parry's was among the strong voices to speak in sympathy to the poor in response to the Poor Law Amendment Act which had been enacted in 1834. "Judge Parry is particularly gifted with that rare imagination which enables him to see mortal men and women where others see cases, litigants, and parties before the courts. Hence his volume is a rare document, especially useful as a corrective to the tendency to lose sight of actual living conditions in the logical pursuit of abstract legal doctrines." Cohen, Law and Social Order cited in Marke, A Catalogue of the Law Collection at New York University (1953) 810.

Now in its 11th edition, Criminal Law and Its Processes: Cases and Materials covers all the doctrinal material and key criminal justice policy questions an instructor may want to explore for a either a one-semester or year-long course in criminal law. From a preeminent authorship team, Criminal Law and its Processes: Cases and Materials, Eleventh Edition, continues in the tradition of its best-selling predecessors by providing students not only with a cohesive policy framework through which they can understand and examine the use of criminal laws as a means for social control, but also analytic tools to understand and apply important criminal law doctrines. Criminal Law and its Processes: Cases and Materials focuses on having students develop a nuanced understanding of the underlying principles, rules, and policy rationales that inform all criminal laws. A cases-and-notes pedagogy along with scholarly excerpts, questions, and notes, provides students with a rich foundation for not only the academic examination of criminal laws but also the application of the law to real-world scenarios. New to the Eleventh Edition: Enhanced treatment of America’s long-overdue reckoning with over-criminalization, mass incarceration, and discriminatory law enforcement Discussion of abolitionist critiques of American penal law and consideration of restorative justice as a possible alternative to traditional punishment The chapter on rape makes more readily understandable the major split between states that still require proof of some kind of force and those that now make absence of consent sufficient. The material also contains more depth for discussion of the increasingly important question of what “consent” means, including several of the most recent cases and the new Model Penal Code provisions on rape approved by the ALI membership in June 2021. In-depth treatment of racial profiling and police use of excessive force, and a broader discussion of structural pressures and biases in the context of exploring the expansion of excuses Broader exploration of what society chooses to criminalize and prioritize for enforcement Updated notes to incorporate contemporary cases and recent news touching on criminal law Inclusion of additional preeminent cases in the field of criminal law, including: Kahler v. Kansas as a principal case in the material on the insanity defense Two new cases on the actus reus of conspiracy – the first in a drug distribution context and the second addressing Apple’s strategy for marketing ebooks on its iPad Professors and students will benefit from: Cohesive Intellectual Framework Grounds student understanding of criminal law as an instrument of social control?and provides analytical tools to interpret and understand doctrine Holistic approach encourages students to develop an understanding of principles and rules applicable to all crimes Cases-and-notes pedagogy Includes excerpted materials, questions, and problems useful for Socratic instruction and policy discussions Challenging Problems ? Places discussion of the law and policy in relevant, real-world scenarios Enhance students’ understanding of basic principles and test their application of these principles to particular offenses
